Terms and Conditions

1. Overview

1.1 Scope of these Terms. These terms and conditions govern the supply of our products to you.
1.2 Please read carefully. Before placing an order, we recommend you read these terms thoroughly. They explain who we are, how we deliver products, your rights to modify or cancel the agreement, how to resolve any issues, and other relevant details. If you spot an error in these terms, feel free to get in touch.

2. Company Details & Communication

2.1 About us. We are Mohanji International Sàrl, registered in Switzerland with company number CHE-358.238.170. Our business address is Chemin de la Jardinière 9, CH-1260 Nyon, Switzerland.
2.2 How to reach us. You can contact our team by email at info@mohanjifragrance.com.
2.3 How we’ll contact you. We may reach out via phone, email, or postal mail using the contact details provided in your order.
2.4 Definition of “written.” References to 'writing' or 'written' include communication via email.

3. Forming a Contract

3.1 Placing an order. You can order products through our website at www.mohanjifragrance.com. If online ordering isn’t possible, email us and we may assist by sending a direct payment link.
3.2 Order confirmation. A binding contract forms when we send an email confirming acceptance of your order.
3.3 Order refusal. If we can’t accept your order, we’ll inform you and no payment will be taken. This may be due to stock shortages, unexpected operational limits, pricing or description errors, or delivery constraints.
3.4 Order reference. Once accepted, your order will be assigned a unique reference number. Please quote this in any communications with us.

4. Products

4.1 Visual differences. Product images on our website are for reference only. Actual colours or appearance may vary slightly due to display settings.
4.2 Packaging variation. Product packaging may not exactly match what is shown online.

5. Requesting Changes

Should you wish to alter your order, please contact us. We’ll confirm whether the change is possible and, if so, inform you of any implications such as adjustments to pricing or delivery timeframes. If changes are not feasible or not acceptable to you, you may choose to cancel (see Section 8).

6. Changes from Our Side

6.1 Minor updates. We may update products or packaging to comply with regulatory changes (e.g., IFRA guidelines) or to improve presentation without affecting the core product.
6.2 Significant changes. If substantial modifications are made, we will notify you in advance, giving you the option to cancel the order and receive a full refund for unshipped items.

7. Delivery Details

7.1 Delivery fees. Costs will be shown during checkout on our website.
7.2 Dispatch timeframe. Estimated delivery timelines will be provided during the ordering process.
7.2.1 Couriers. We work with DPD, FedEx, and DHL. Your delivery preferences set with these carriers apply. Please ensure your preferences are up to date. Mohanji Fragrance is not responsible for delivery issues stemming from settings you've configured with the courier.
7.2.2 Shipping charges. UK delivery costs £15. International shipping is £30 (excluding customs duties or import taxes).
7.3 Delays. We’re not liable for delays caused by events beyond our control. If affected, we’ll inform you and try to mitigate delays. You may cancel the contract if the delay is substantial and receive a refund for undelivered items.
7.4 Missed delivery. If no one is available at the address, the courier will leave instructions on how to reschedule or collect the package.
7.5 Failure to arrange redelivery. If your order is not redelivered or collected, we may cancel the order and deduct costs incurred (see Section 10.2).
7.6 Responsibility for goods. Ownership and responsibility for the items pass to you once delivered to the address provided.
7.7 Ownership. You legally own the product once full payment has been received.
7.8 Incomplete customer information. If necessary information (like delivery address) is missing or inaccurate, we may cancel the order or charge extra for corrections.

8. Your Cancellation Rights

8.1 General right to cancel. You can cancel based on:
- 8.1.1 Faulty or misdescribed products (see Section 11).
- 8.1.2 Changes we’ve made that you disagree with (see 8.2).
- 8.1.3 A change of mind (see 8.3), provided the product is unopened and unused.
8.2 Cancellation due to our actions. You can cancel if:
- We change the product or terms.
- A pricing/description error occurs.
- Delivery delays are significant.
- We breach the agreement.
8.3 Cooling-off period. You have 14 days to change your mind under Consumer Contracts Regulations 2013. If dispatched, refuse delivery or return the product yourself.
8.4 Customs fees refusal. If you decline a package held due to import duties, it will return to us after 14 days.
8.5 Non-returnable items. You cannot return unsealed hygiene-sensitive products (e.g., opened fragrances). Returned products must be unused, in original packaging, with all components and any free gifts.

9. Returning Products & Refunds

9.1 Inform us. Email info@mohanjifragrance.com with your cancellation and order details.
9.2 Return process. Products must be returned within 14 days of your cancellation notice. Contact us for instructions.
9.3 When we cover return costs. We pay return shipping if:
- 9.3.1 The item is faulty or misdescribed.
- 9.3.2 You cancel due to a change in terms, a delay, or our error.
9.4 Return collection. If we collect the item and you are responsible for the cost, we’ll invoice you accordingly.
9.5 Refund method. Refunds are issued via your original payment method.
9.6 Refund deductions. We may reduce refunds if:
- 9.6.1 The product was handled beyond what's acceptable in a shop.
- 9.6.2 You selected a more expensive delivery method than our standard option.
- 9.6.3 Services were partially delivered.
9.7 Refund timeline. Refunds are processed within:
- 9.7.1 14 days of receiving the returned item or proof of return.
- 9.7.2 14 days of cancellation (if no return is required).

10. Our Right to Cancel

10.1 Termination by us. We may cancel if:
- 10.1.1 Payment isn’t made on time.
- 10.1.2 Required delivery information isn’t provided.
- 10.1.3 Delivery/collection isn’t arranged.
10.2 Refunds on cancellation. If we cancel, you’ll be refunded any prepaid amount for products not supplied.
